Although, as readers know, these surveys are scientific – even in the same way as the science of macroeconomics – I would like to point out that the lists of professors used in this case were particularly controversial. In general, schools included more teachers in their L&E group than the lists reflected, although correspondents sometimes used different criteria for admission and exclusion: for example, many treated all those who had submitted to the ALEA (American Law & Economics Association) as part of the L&E group, while others placed more emphasis on formal education. For the purposes of a survey of specialists in the coming months, we will only submit complete lists of professors to reviewers and ask them to assess which faculty contributes significantly to a law school`s L&E strength. One observation on our investigations so far: In two extremely prestigious areas of jurisprudence – constitutional law and theory, and law and economics – Harvard has beaten Yale (with a clear lead in L&E, only slightly in constitutional law). (NYU also beat Columbia in both categories, although that`s less surprising in my opinion.) We will see if this result remains stable in the survey of specialists.
